Subject: Application under Article 34 of the European Convention on Human Rights —
Systemic Persecution, Judicial Collusion, and Denial of Justice in the United Kingdom

Dear Registrar,

I, Iain Clifford, a British national and financial whistleblower, currently living in constructive exile in North Cyprus, submit this formal application under Article 34 of the European Convention on Human Rights. I present this application as a result of a sustained and escalating pattern of:

  • Regulatory sabotage by the Financial Conduct Authority (FCA),
  • Judicial collusion in the UK courts,
  • Fabricated prosecution without lawful authority,
  • Reputational defamation by state-aligned actors,
  • And denial of domestic legal remedy due to a General Civil Restraint Order (GCRO).

Chronology of Persecution (2005–2025)

  • 2005–2006: Whistleblew on fraud at HBOS, regulators and Parliament failed to act.
  • 2010: Integrity was liquidated. FSCS blamed Integrity falsely, paying £80 million due to HBOS actions.
  • 2010–2018: FCA sabotaged seven ventures, blocked good faith applications.
  • 2012: Exposed £50M fraud by Richard Clay. FCA warned me off testifying.
  • 2017: FCA fabricated case against Stargate Capital. Named me 75 times in public notice.
  • 2018: Judicial Review into FCA action was struck without explanation.
  • 2023: Unlawful arrest via Order 34/2023 under fictitious “Alastair Mackenzie.”
  • 2024: Judicial Review denied. GCRO issued. No appeal allowed.
  • 2024–2025: 500+ witness statements submitted. All motions ignored.
  • June–July 2025: Notices served: Rescission, Strike Out, Stay, Estoppel, Cease and Desist, Recusal.

All notices unrebutted — binding estoppel established (Tinkler v HMRC [2021], Unilever Plc v IRC).

Continued Use of Fictitious Prosecutor

  • FCA and court still use “Alastair Mackenzie.”
  • According to FCA Register, he has no enforcement powers.
  • No listing in Law Society, FSMA or POCA jurisdiction.
  • Constitutes fraud, impersonation, abuse of process — violates Article 6 and 13.

Denial of Service and Constructive Exile

  • Reside in North Cyprus. No UK domicile.
  • All service addresses rescinded.
  • FCA has no jurisdiction. Substituted service = fictitious service.

Precedents: Kukayev v Russia, Tatishvili v Russia (2007), Anufrijeva v Southwark LBC [2003].

Civil Constraint Order as Denial of Remedy

  • GCRO bars legal claim even if new evidence arises.
  • Violates Articles 6 and 13.
  • Allows Crown actions to go unchallenged.

Ongoing Reputational Attacks and Coordinated Smear Campaign

  • Dan Neidle falsely called Matrix Freedom a scam in June 2024.
  • Simon Goldberg operates Empower the People — 4-year smear campaign.
  • 200+ YouTube videos, fake websites, mass mailings.
  • Defamation action blocked by GCRO — violates Article 8.

Defective Judgment by Judge Anthony Baumgartner (16 July 2025)

Ignored all affidavits, recusal notice, and jurisdictional defects. Dismissive language used. Violates Articles 6, 8, and 13.

Pending Arrest Warrant and Interpol Concerns

  • Expecting unlawful arrest warrant.
  • Submitted notice to INTERPOL against misuse of Red Notice.
  • If no reply in 14 days, silence = tacit agreement (Unilever, Tinkler).

Complaints to Domestic Authorities

  • Attorney General – Public inquiry requested
  • Serious Fraud Office – Complaints re: Boffa, Stone
  • JCIO – Complaints re: Baumgartner, Sweeting
  • FCA Complaints Office & Commissioner – No investigation

Conclusion and Request for Urgent Relief

Due to exhaustion of domestic remedies, institutional bias, reputational harm, and denial of justice, I request the Court:

  • Acknowledge this letter as Article 34 application
  • Accept forthcoming documentation including affidavits, estoppels, motions
  • Consider interim Rule 39 measures to prevent arrest or extradition
  • Register matter for urgent Article 6, 8, and 13 review (Grand Chamber if needed)
